VW & Audi Timing Chain Tensioner Lawsuit

Last week, McCuneWright filed a class action lawsuit in federal court in New Jersey on behalf of consumers who own model years 2006-2016 Volkswagens and Audis with 2.0L gasoline engines.

McCuneWright is interested in speaking with and representing additional consumers who have incurred out-of-pocket expenses related to a defect in the vehicles' timing chain tensioner, described below. The lawsuit seeks recovery of all out-of-pocket expenses paid by consumers to remedy the defect.

The lawsuit alleges that the timing chain tensioner is defective and eventually fails due to no fault of the consumer. The timing chain links the crankshaft to the camshaft and, when properly tensioned, ensures the valves and the pistons operate in sync. When the timing chain fails, the valves will begin to collide with the pistons and the engine may begin to rattle or fail to start. Eventually, an improperly tensioned timing chain will cause catastrophic engine failure.

The lawsuit also alleges that Volkswagen and Audi have been aware of the defective nature of the timing chain tensioner for years but failed to inform consumers of the defect and routinely blames the timing chain tensioner failure on improper maintenance. It has been further alleged that in late 2012, a production change was implemented to remedy the defect but Volkswagen and Audi failed to inform consumers of the production change.
