My car was having the passenger restraint malfunction displayed on the screen and it was intermittently on and off for a long time but recently the fault is constantly on doesn't matter what I do even when I have the passenger or not. This is a safety issue so searched to understand it better and found the NHTSA campaign id number: 08V384000 for the recall of the passenger seat mat defect which covers my car but for some reason I've contacted the BMW dealer where I bought my car from to see if I can get it fixed based on the recall for free of charge but the dealer told me that I car is not covered even though my car is one of defected car based on manufacturing date. The cost of the mat replacement is over $1000, I think BMW should fix my car for free since this is a safety recall issue. Please have BMW to include my car in the recall list.

I was never contacted by BMW about a recall since my vehicle is not listed as being defective, but it clearly is. I'm certain that I am not the only 2006 BMW 325I owner that has had this issue, and the recall should be extended to all models, not just the sport seat model. When an adult is seated in the front passenger seat of the vehicle, the air bag service indicator, no seatbelt indicator, and "passenger airbag is disabled" indicator are all illuminated. When taking my vehicle in to the local BMW service center to diagnose the issue, I was told the cause was a faulty passenger seat sensor mat (have documentation), which is meant to detect when a passenger is present. In addition, I was told in my vehicles current state, if I were to get in an accident with a passenger present, the passenger airbag would not deploy. While performing independent research, I found that BMW has released an official recall (#08V384000) which describes these same symptoms, caused by a defective passenger seat sensor mat. In the recall details, the make, model, year and seat type all match the specifications of my vehicle. After discovering the recall information, I contacted BMW of North America representative by telephone. I was told that because my vehicle VIN is not on the recall list, the repair must be done at an out of pocket expense. I am filing this complaint because the defective seat sensor reduces the safety of the vehicle passengers, as well as violates air bag regulations established by the NHTSA. Since this is a defect, the cost should be covered 100% by the manufacturer, BMW.

This defect has already been verified by an authorized BMW dealer at my own cost. But for some reason, my vehicle in not one of the 200,000 vehicles in the official recall. So BMW refuses to take care of the problem. I filed a complaint with BMW na but they will not cover this problem. This is a safety issue because my passenger side airbag is now disabled permanently because of this defect.

Recently my 2006 BMW 325I's airbag and seat belt warning light came on. The problem started shortly (one month) after it came off the factory warranty. It was intermittent and I was extremely busy so I did some research and discovered there was a manufacturers "voluntary recall campaign" I never received notice but noticed the recall noticed the recall EA08-001 mentioned cars with sport seats as part of the problem. I called BMW na and was told that my VIN did not qualify. Over time the problem worsened ad eventually last month the lights just stayed on. Again calling BMW na they suggested I visit my dealer to hook up the car to their diagnostics machine. I took the car in and they confirmed that the seat mat sensor was the problem and replaced it for a total of $990. I contacted BMW informing them that the seat sensor should be covered under the terms of the recall and I offered to pay for parts if BMW would pay for labor. I was informed that they would inform me of the corporation's decision in 5 business days if they would compensate me for the repair due to my vehicles low mileage. I was just informed today they would not compensate me at all today due to my payment after the sensor was replaced. They also added that they almost never compensate after services are payed. I believe that since front passenger seat occupancy detection mat disables the passenger air bag system it is an essential part of the vehicle's safety system as acknowledged by BMW nhsta campaign number 08V-384 and confirmed by the NHTSA engineering analysis EA08-001. I believe that BMW is not conforming to the intent of this recall program and is limiting their liabilities due to defective components.

I am asking that NHTSA issue a letter directing that my vehicle VIN be included in the recall so that the system can be restored & the warranty be extended as directed in the BMW recall of 2006 3 series sport seats.
