My new 2013 Elantra is only getting 23.3 MPG. Dealer claims it is because the car is not "broken in" yet. Sorry Charlie, but 6 MPG will not be made up after breaking in. Is there any recourse for such significant difference?

I purchased the "2012 North American Car of the Year" in May. I bought the 2013 Elantra. I quickly realized that the gas mileage was not even CLOSE to what is advertised! I called the dealership and they told me to give it a few tanks and that it should improve...that the car has an "adjustment" period when it is new. I didn't buy it of course, but figured I would wait as suggested. After 1000 miles, the car is still averaging 22.3 miles per gallon, and that includes a three hour highway trip! I have been told recently that there is a current class action lawsuit out of California for the same issue on the 2010 and 21011 Elantras. I plan to pursue this issue as far as necessary.
