To Attorney General ,Hi My name is Marisa Mitchell my story begins as a happy one, but soon turns out to be my worst nightmare back in November 2007 .I brought my first car a 2007 Nissan Xterra from Avondale Nissan in Phoenix Arizona brand new which is now paid off for. It was very nice vehicle which had really small issues with normal wear and tear and normal maintenance which I kept up on myself.

Right now I’m attending ASU for Premed and I need my vehicle to get to school. The issue started when I was driving on the Highway, all of sudden I heard a noise at the back end shuddered as if I was driving over rumble strips. I took it in on my next oil change to discovered that out that my transmission fluid was into the coolant, Which then I had the radiator change , then to discovered a couple months later my engine light came on and the same issue which I was previously having with the my transmission fluid was into the coolant began again.

In addition to that incident, I was told from numerous dealerships including Nissan that radiator was damaged and now the transmission was also damage. I then started goggling the problem and to my surprise to find out that so many other Nissan owners were experiencing the same problem. This horrified me when I went to the dealership where I purchased it new in 2007. The Service Advisor in the service department told me this is a terrible problem because Nissan is aware of This is a horrible design flaw on Nissan's part and they’re not doing anything to help their customers, he said that Nissan is not going to do a recall at all its just a defect . He also stated that to fix’s the transmission and get another radiator which cost $ 500 for the radiator and$ 5155 for transmission not included tax or labor.

I WILL NEVER IN MY LIFE EVER BUY A NISSAN AGAIN NOR WOULD I RECOMMEND SOMEONE TO PURCHASE IT! They all have an action lawsuit against them so register so you can help solve the problem.

Needless to say, I still am figuring out what to do. I purchased an Xterra at the beginning of the year. I had the problem that many people are having where the radiator and transmission failed simultaneously. I am currently paying a $292.00 note on a car that will not move. I felt comforted in the fact that I purchased the extended warranty with coverage for 100,000 miles or 6 years after the purchase. The factory warranty will not cover the cost to repair the radiator. They will not even work with the fact that the radiator caused the problem. Even though I have warranty coverage for transmission, the same dealership that sold me the expensive extended warranty and overcharged for the car is trying to charge $7700 for the job with new parts or $5500 to do the job for used parts. They also humiliated my spouse when they made it seem as though we needed to get the job done with new parts, which made us feel pretty cheap. I know now that the job would have to utilize a new radiator because the original radiators are causing coolant and transmission fluid to mix. I have extended warranty for over 85,000 miles still. I am seeing reports that Nissan is starting to recognize the fact that they have faulty radiators but is not holding themselves liable for any of the damages to any of the parts of the car even though most it is under warranty (even though everyone's radiator should have a factory recall by now). There is even a New York Times article about the radiator/transmission problem with multiple Nissan models. It is written in the contract that if the radiator causes the problem, then the transmission damages will not be covered. Also the radiator, which seems to be the part causing all of the problems, is not even covered at all in the warranty nor is it under a factory recall. I purchased a certified pre-owned car with a warranty because I did not want to have a car that would give me further financial troubles in costly repairs. Now I feel as though if I purchased an old car with the money I spent on the down payment, I would have gotten more for my money. Nissan is aware of this problem, but does not take any responsibility because of how much it would cost to repair radiators and/or transmissions for everyone that owns an Xterra, Frontier or Pathfinder.

After reviewing many complaint about this issue, my is the same classic story. 115,000 miles!

First, the heater was not working, was not producing heat while the car was idling. Then, I noticed a shuddering or shaking in the vehicle when I was going around 50-60 MPH. After that, the vehicle was slamming into gear, it would jump when shifting from 1st-2nd gear.

I took it into Nissan just yesterday to have it looked at. Their report was that the radiator had a crack or was broken in a manner where the coolant fluid was leaking and mixing with the transmission fluid, causing the transmission to slip.

Their recommendation was to replace the radiator and transmission and to flush the fluids. This was going to cost me around $6,000. They have no manufacture transmissions, Nissan does not make them anymore, so I am searching for a rebuilt one and plan on fixing the problem myself.

As soon as I picked my X-Terra up from the dealership, it did not drive the same, it was driving rougher than usual and ironically the the check engine light came on. Upset that this had to happen, no extended warranty. Super upset.

this is my first japanese car, i always buy american car and never had a problem especially with a

transmission. my 91 jeep cherokee had 400 hundred thousand miles. i tried so hard to kill that

jeep but it wouldn't die. i give to church for donation. my friend always tell me to buy nissan he

said it's the best truck in world. now i know he is full of sh*t because how in the world a brand new

2007 XTERRA of 79100 miles transmission got destroyed because the radiator blow up

coolant mixed with transmission fluid. i wrote a letter to nissan america they said nothing

they can do . nissan is the biggest scum bug in the world. first they said 72000 miles

after three months 80000 miles. my xterra got busted 79100miles and there is nothing

they can do. i will tell the world do not buy any nissan car or truck because nothing they

do if your car or truck got any problem because they are scum bug just want your

money

My 2007 Xterra has been awesome until now. About 1 week ago i noticed that occasionally while accelerating, the back end shuddered as if I was driving over rumble strips. When I googled the problem, I was amazed to find that so many other Nissan owners were experiencing the same thing. I have taken my Nissan religiously for service appointments to the dealership where I bought it new in 07 so I called my guy in the service department. I hadn't even gotten past the words, "rumble strips" when he cut me off and finished the story. He said that this problem is so rampant that they are more than 3 weeks back-ordered on new transmissions for these vehicles! I asked if Nissan was going to do any recall or compensate their customers and he said, "No, unfortunately not. This is a terrible problem and we are buried with people coming in for the same thing." He added, "This is a horrible design flaw on Nissan's part and they aren't doing anything to help their customers by only extending the warranty to 80,000 miles as the problem usually occurs just beyond that point." I asked him point blank, "Am I F_d?" To which he relied, "You're F_d. If you do pay the cost of a new radiator and transmission, the design is flawed and this will eventually happen again"

As for now, my Xterra is sitting in the driveway and I am trying to contemplate my options. According to the dealership, I should not drive it at all even to get it to them as the transmission will completely disintegrate if it hasn't already.

One mechanic friend suggested having the radiator replaced and the transmission flushed as a temporary fix for roughly $500.

So to Nissan I ask the following: Am I to understand that due to a faulty design on your part, I now have to pay close to $7000 after towing, parts and labor for a fix that is only temporary? Is that how you treat your lifelong, loyal clients?

Ok I'm the latest sucker who owns a Nissan. 2007 xterra - Car overheated got it to the closest garage they found the problem with a cracked transmission cooler and filled the transmission with coolant. Towed it to the closest Nissan dealer and they confirmed the problem. Repair bill is $7400. When I called the dealer that I purchased the car from he said "Sorry this is a Nissn Issue" my response was what is that sign out front of you show room say !!!! they could of cared less. Checked this website and found that I was not alone.... Called Nissan customer support and renamed it "Lack of customer support" They took a lot of information but did not even sound concerned. They called back after a week and said you are on your own...... Called the Maine Attorney Gennerals office and found Maine has an Implied Warranty law. The AG sent the dealer a letter and the service Mgr called me crying about its not his fault... It gets better !!! After a long discussion he tells me the problem is because I did not bring it back to his dealership to change the coolant, then goes on to tell me there was a recall up to 80,000 miles. I Never recieved a recall notice !!!!!! He actually started arguing with me.

I'm still working with the AG'S office and the class action law suit I've owned a lot of vehicles but have never been treated so poorly buy a car company. They know they have a problem and are ignoring it . Make sure you make a lot of noise about Nissan. I've convinced 5 people who were considering Nissan to go to another brand and will continue to. We are considering a little PR campaign at the Maine Mall Nissan Dealership in Portland Maine. I'm Mad and I'm going to get even !!!!!!
