This is to add to the problem with brake lights coming on without hitting the brake pedal and turning off when brake pedal is depressed. Has anyone had this fixed and what was fix and cost?

I purchased my Chevy Malibu 2010 from CarMax in Brooklyn Park MN July 2015. By August of 2015 I noticed that the brake lights was staying on while I was driving on the highway at high speed. I took my car back to CarMax in BROOKLYN PARK MN and I was told; oh well, it's probably cause it's cold outside. What the heck is that?

No, that is not the reason. I have been going back and forth with CarMax about this issue. March 10, 2016 I was almost hit because the driver behind me did not know what I was doing. I am driving on the highway at high speed but At this point I went off on CarMax and demanded something be done. So far nothing has been done.

I have had my Malibu into the dealership 4 times for this problem. It seems to be connected to the Service ESC, Traction control warning. This week, the dealership replaced brake parts to fix the esc problem, but the brake light issue continues. The dealership has put on the "collar" that was supposed to fix the corrosion problem on the EBCM. Problem still occurs. My local mechanic has given up on trying to figure out the problem. Someone at GM must know what needs to be done!

Just bought this car and on the 2nd week I noticed that my brake light is always on (annoying when I see it in mirror and most my driving is at night) when I brake it goes off then chimes back after 5 seconds. So far it hasn't interrupted cruise control. When it gets annoying I just lightly tap break to get it off and normally "fixes" issue for a few miles. Recall needed before I get pulled over for it or rear ended cuz those behind me can't tell I'm breaking.

Update from May 24, 2017: Now 3 years later and my car has been "fixed" 4 times for the same recall. After the second time it broke again I contacted GM corporate and they were quick at responding. I took it back to the shop and they failed to "duplicate" the issue. They claimed to have repeated the recall and handed back the keys. This was 3 months ago. Last night my brake light started to illuminate again. Emailed corporate again. I'm about ready to just give up on them fixing it because I can't afford to go without a car for a week for them to put a temporary bandaid on it.

Update from Jul 5, 2017: Finally drove my car to the dealership while my recall was acting up and they witnessed it but could not get diagnostic code before the car started working properly. They have now determined that the issue is the BCM is faulty which is not covered under the recall and corporate denied the fix. Was quoted 275 plus tax to fix this. Thankfully I have an extended warranty that is covering it 100%.

This is a very bad safty issue. Nobody behind me knows what Im doing. I have 2 small kids. If someone hits us it could kill us!! Because of a manufacture defect , my family & I could get killed just being on the road in that car!!!!!!!!!!!
