I brought a brand new BMW IX fully electric vehicle in May, 2023. A couple of weeks ago in early September, the -??Emergency Call System Malfunction-?? warning light came on, and I can also smell a chemical burn from the vehicle. I dropped it off to Eastbay BMW in Pleasanton, California. 4350 Rosewood Drive, Pleasanton, California 94588. They confirmed that the -??Control Module-?? may be over heating and causing the emergency call system to malfunction. Eastbay BMW contacted BMW HQ and was informed to just reset the warning light. -??BMW advised Eastbay BMW that this is a recurring problem and the unit may overheat-??. Eastbay BMW also confirmed that their technicians confirmed the warning codes showed the Control Module may be over heating. Instead of replacing this control module and finding a longer term fix, BMW HQ decided to decline replacement request and to simply reset the warning light until the next incident occurs. I have read on different BMW owners forums that this is an ongoing issue, occurring in many new vehicles as my BMW IX has less than 1,500 miles and we live in the Bay Area, California where it does not get too hot. Given that this relates to and impact the emergency call function, I want to file this formal complaint to ensure BMW address this issue properly and that the NHTSA launch a full investigation. I am writing to you once again to report my concerns that BMW is not in compliance with NHSTA requirements that recalls be repaired in a 'timely fashion.' This car has a recall for the driver's airbag that was issued in mid February of this year. It his now 3 months later, and my dealer tells me it will likely be months from now that they can finally replace the faulty airbag. It is very very distressing to have to drive a car that is less than fully safe. I cannot understand why BMW USA refuses to cancel my lease and take back the car. I cannot buy the car and sell it to someone else because of the recall (even though this option would lead to a significant financial loss to me)--because of the recall, I cannot buy off the lease. A 5-6 month delay to fix a faulty driver's side airbag is NOT a prompt repair. i am once again asking NHTSA to force BMW USA to take back my car and cancel my remaining lease payments so that I may get a fully safe car to drive. Thank you for considering this request.

The dealer says it will be many weeks to months until they have replacement airbags available. I had a phone call with BMW USA customer service and they say the same thing. It is not a timely repair. I want to return car from lease but BMW refuses to accept it. I also cannot buy car off lease to sell to someone else. I hope NHTSA will require BMW to take back this unsafe car because they cannot make timely repair. Thank you.

I am writing to you about the current recall you have on the airbags for this car. I spoke today with BMW USA Consumer Relations and they tell me that it may be weeks or months until the replacement airbags are available. I am very worried about driving a car for so long where the airbags are not reliable. I am surprised that BMW is allowed to have me wait for months for a replacement of as vital a safety feature as driver airbags. In the meantime, I cannot sell the car, I cannot purchase the lease as there is a recall. Plus BMW refuses to allow me to end the lease. I hope you will consider making this a 'do not drive' recall instead of putting drivers of this very expensive car at risk for so many weeks. Thanks for your attention to this request.

Air bag may not deploy on drivers side causing potential death to a driver that is already a chronic neck pain, poising a worse threat to the driver.
