Our son has been driving for 3 and a half years and this was his first accident. He has never even had a ticket, but as he turned, he felt it pull away on its own and he tried to overcorrect to keep it from crashing. It wasn’t going too fast, but during the turn it strangely acted like it was on its own and he couldn’t keep it from going up on the sidewalk and grass on as he had turned left at the intersection. It just malfunctioned or something, so he tried to correct and turn away from the right side (which was the side with grass and sidewalk) and it wouldn’t gain control. To avoid a head-on into a tree he kept trying to direct it straight, but it went up on the grass sideways and bumped a pedestrian and he hit his mouth on the steering wheel because the airbags didn’t deploy.
I'm not sure why not. He was almost being attacked by a few crazy people in a group of other people who assumed a teen with a car like that must have done it on purpose and threatened him and his friend. No police were there and when they showed up, they didn’t arrest him because he was at the scene. He tried to help the person hit but others were crowded already and it was so unsafe and bad for him and friend. Then the police came.
We are now fighting this because we feel he is getting the blame for something that he wasn’t doing. The police were declaring it an accident and that he lost control. He was picked up by a friend and the car was towed. A few people who were obstructing traffic wanted to assume he did a burnout, which he didn't - he never accelerated nor left any marks, nor did airbags go off. He was really just trying to avoid hitting anyone but something caused this car to act up and it was discriminatory for an officer who wasn’t there to make my son the scapegoat because he is a teen in a car like this. He has never done anything prior, and to not believe him, and if an adult or woman did this same turn and lost control with a sedan car going the same speed it wouldn’t even sound loud, so it wouldn’t be assumed that if it’s loud that it’s fast. This car sounded loud or fast at 6 mph so the same could happen with anyone, any car, and would see it as the accident it was or a car malfunction.
This car was take quickly and even though they asked for the insurance card and had the info, they never contacted them and just put the car into a tow yard with the windows down while raining. We weren’t home and he had a busted lip with braces stuck to lip so they were supposed to get the insurance person to authorize where to take the car and check the scene, but they didn’t and that car sat and with the tow yard closed on weekend, we had to wait while it rained with windows open and no way to get someone to check it for what happened.
