The transfer case on AWD models of the CX-9 has been an issue for MANY years now and apparently still is for 2013 model year. I had 28,000 miles on my CX-9, just hit 2 years old and it was making a stinking burning smell and dropping gear oil on my garage floor. So, I did the best I could to replace the gear oil (it's supposed to last forever apparently) and the stuff that came out was just a thick black sludge.
I'm not ready to deal with taking my car in for service and getting a new transfer case so I've taken it upon myself to keep it operational, for now. If you search the issue though you will discover this issue has been going on a LONG time and Mazda doesn't seem to be fixing it. If there is a reliable transfer case I'd be getting one but I see no point to get another one that hasn't solved the inherent problem if I can keep it functional until there is one.
