On 10/26/20 I was rear end, I own a 2006 clk 350 Mercedes. I was sitting still in my, a car hit be in the rear causing my head restraint to deploy. From that dual impact, I sustain traumatic brain injury, lumbar and cervical injury and diplopia ( double vision) ringing in ear (tinnitus) equilibrium,

The car-seat occupancy mat sensor which is built into the front passenger seat bottom is defective. The Mercedes dealer told me that the replacement part is not available and the only way to fix the problem is to completely replace the seat at great expense. I was also told that since the SRS system warning light is on the entire airbag system is disabled. In the event of a collision the airbags will not deploy. I also had to replace the clockspring in the steering wheel which was also causing the SRS light to come on. The parts and labor bill was over $600.

While parked I started the car and placed an item on the passengers seat. Immediately the SRS light came on. The SRS has detected something wrong with the airbag system and shut the airbags off on the car which is an extreme safety hazard. After taking the car to the mechanic I was told code 9223 and 9080 displayed. 92 23 states that the car needs a contact reel at steering wheel (part $410/labor nearly $300) and 9080 states the passenger side seat bottom needs to be replaced (part $1690/labor nearly $300). I believe this should be a recalled item because numerous Mercedes Benz have this issue and the repair cost is extremely high. Please investigate this safety issue. Due to the extreme cost for repair, I am driving an unsafe and hazardous vehicle. I am sure, I am not the only person in this situation.

Warning message displayed, "SRS restraint system malfunction visit workshop" upon investigating this error message on the internet Mercedes Benz forum, I have determined the following: 1. this is a very common problem, affecting several mb models, including the E-class, C-class, slk, clk, and possibly others. 2. when this message appears, the driver air bag is most likely disabled. 3. mb service bulletin pb-91.60/93D acknowledges this problem as a design or assembly error, and recommends replacement of a wiring component in the steering column. 4. mb service personnel are often unable to make the proper diagnosis and fix. 5. many mb vehicles are being driven daily with this problem, due to the cost ($700) and inconvenience of taking the vehicle to the dealer for problem correction. Due to the potential for personnel safety due to failure of the driver airbag in a frontal collision, and due to the apparent frequency of occurrence of this failure, corrective action should be initiated by mb in the form of a mandatory correction.

My complaint is against Mercedes-Benz, usa for their failure to inform me of the substantive defects and recalls at the time of my purchase of the 2006 Mercedes C280; VIN [xxx]. on April 24, 2009, I engaged in a contract with Mercedes Benz financial services for the purchase of the above 2006 C-280. I was never informed of the serious defects on the vehicle. I was never given an opportunity to make an informed decision. Hence, the business practice of Mercedes Benz and or it's dealership was deceptive. It is hard to imagine that anyone, let alone myself, whose medical impairment of fear, anxiety and panic disorder (ada act) would purchase a vehicle with full knowledge of the risk factors involved; during and prior to the purchase, pursuant to: A). report date:December 3, 2011 at 07:19 am mfr's report date: Dec 15, 2005...NHTSA campaign id number: 05V560000..component: (air bags)... consequence: In the event of a crash, an occupant may not be properly restrained which could (result in injuries).. dealers will install a new air bag inflater module free of charge Mercedes-Benz recall no. 2006020005. The recall began on March 15, 2006. B). December 3, 2011 (NHTSA campaign id number): 08V303000...(component): Electrical system.... Mercedes-Benz recall no. 2008 070001 thank you for conducting an investigation on my complaint.[xxx] information redacted pursuant to the Freedom Of Information Act (FOIA), 5 U.S.C. 552(B)(6).
