Original problem was that the tie rod snapped off the left front wheel, causing a loss of control of the car. The car hit a gurad rail, was moving at 45mi/hr neither the driver or passenger side airbags deployed. Police report was issued; however, did not include any information about the details of the wreck. Driver suffered from minor neck and spinal injuries. Insurance adjuster rated the car as totalled and the car was destroyed, leaving no proof of airbags still being intact.

Following the car accident I was in a body brace for months and the last thing I wanted to do was deal with lawyers. SO I did not file a lawsuit. I am going to post this in case someone else finds themselves in the same position. Looking back I wish I had filed the lawsuit so that medical bills, etc would have been covered.
There was a malfunction on the back end of the car which resulted in losing control of the car and several impacts. There was front impact, side impact and rear impact yet no airbags deployed. I was on the freeway and travel about 60 to 65 mph so I never quite understood why the airbags did not deploy. The car was considered totaled by the insurance company.
I was taken to the closest trauma center following the accident. The seat belt caused complications to my chest area, which were felt immediately. Had the air bags deployed they would have helped to deflect some of the pressure away from my chest plate. I was of course put into full c-spine and taken to the hospital via ambulance where I was diagnosed with a fractured (broken is considered improper medical terminology) neck. I was in the trauma unit for over a week and had to stay in a body brace for almost six months until my neck healed.
To this day the pain from that car accident is very much present and I will be undergoing surgery in an attempt to ease it this year. I am dealing with the situation still six years later. The accident was in 2010 and it is presently 2016. I truly hope this helps someone else who may have found themselves in a similar situation. More over while I have always been happy with Nissan vehicles, I think they need to be held accountable for situations like this.
