I was driving forward and following another vehicle. It slammed on the brakes suddenly causing me to hit the back of the vehicle in front of me. I am supposed to have forward collision detection and automatic braking and neither one ever engaged to avoid the crash.

On September 1, 2023, I was headed north on I-95 in North Carolina. I was involved in a 3 car pileup where the Automatic Emergency Braking and Forward Collision Warning on my 2021 Nissan Rogue failed to activate. My vehicle had ADAS but almost killed my mother and me since they did not work. The car was totaled and the State Trooper wrongfully cited me for failure to reduce speed even though my foot was firmly on the brakes. The airbags were severed during impact and failed to deploy.

AEB/ABS braking system lights came on. I've had prior electrical problems with this car so I assumed it was an electrical malfunction. When I took it to the Nissan dealership they told me there was a brake fluid leak in the ABS actuator. The warning lights started Friday August 4th 2023. I took it in to get diagnosed Thursday August 10th 2023. I bought my 2021 Rogue in Jan. 2023 from Carvana with no knowlege of accidents or prior issues within the first few weeks I had issues with the distance sensor which Nissan recplaced. I have not had any accidents with the car since I've owned it.

The vehicle then experienced phantom braking and came to a complete stop, almost causing the vehicle behind him to crash into the vehicle. The contact veered to the side of the road. The contact turned off the vehicle. The contact stated that upon restarting the vehicle 10 minutes later, the vehicle responded as needed and he was able to drive to his residence. The vehicle was picked up by the leasing company. The dealer and the manufacturer were not notified of the failure. There was no further information provided. When trying to start the car I had to push the Brakes almost to the floor to get it to start. THEY WERE EXTREMELY SOFT TO GET IT TO START THE ENGINE AND THEN THEY WERE GOING TO THE FLOOR BEFORE COMING TO A STOP. THEY ARE ALMOST TO THE FLOOR WHEN SLOWING DOWN OR STOPPING. Then while I was driving to pick up my prescriptions and approaching a Stop Sign, then 3 Stop Lights or approaching a vehicle that is already stopped in front of me my brakes are extremely soft and do not engage. They almost go to the floor. The car does not immediately slow down or come to a stop. I have to keep pumping the brakes and even then they were Extremely soft and went almost to the floor before Stopping. I have small feet Size 6-7 and One time my foot slid under the pedal. I had to use the Parking brake at the Stop Sign and the Stop Lights to feel comfortable enough that I would not move forward and be sure I that I came a full Stop. I pulled into a McDonalds Parking Lot less than a mile from my home to see if I turn off the car it will reset the brakes and it did not work. I called Elevated Nissan in Merriam, Kansas which is the Dealership I purchased it from (less than another Mile away from the McDonalds) they were closing in 25 minutes, so I drove less than 5 mph to get there and dropped off the vehicle. I showed [XXX] in service how they would go to the floor. He called me the next morning and after the vehicle sitting in the shop all night long the brakes engaged in a normal fashion the next day. They are trying to find out what is causing them to go soft. These Brakes can cause a Serious Catastrophe resulting in injury or worse. While driving down a road at 40mph that has a speed limit of 45 there are a set railroad tracks that you go over. Of course I slow to 20mph but the forward collision warning activated but it was not a warning but an out right complete stop of the vehicle which would have cause rear end collision if someone was behind me. And it was reported to Nissan about the situation and requested to disable this safety feature but was denied.

While our son was trying to align car in drive outside our home garage door, going from R to D, dash lit up with all red warnings and could not put into park. Car started to roll back. My husband went to assist our son who was behind wheel and now believed the car to be in park. When my husband went to get behind wheel and my son was getting out, car started rolling backward getting close to our neighbor's garage door. My husband and son both fell from vehicle beside drivers door. My son put arms up onto open door trying to prevent car from further rolling and to prevent his father from being run over. Car finally stopped, aaa was called and vehicle towed to dealership. Car has approximately 1300 miles on it, and was taken to dealership twice to repair/replace/check sensors.
