On Friday May 3rd I was driving East on US Highway 41 (Miami) at 7pm and when stopping at the traffic light in front of Turnpike North exit (close to 117 Av) my brake system malfunctioned, the tires produced a metallic sound and the pedal slid to the end; I had to use the Emergency brake to be able to stop. I then was left standing in a fast and wet road with poor lighting at a rush hour, a sure accident waiting to happen.

I called Roadside Assistance service which took 2 hours to show up (2 different companies were called to assist). Before that, a car driving in high speed crashed my car as the driver missed my hazard warning flashers.

When the dealer reviewed my car they said that it was a function of the AEB Autonomous Emergency Braking a "safety feature" that I understand has malfunctioned in other new Nissan Rogue vehicles.

I purchased a 2018 Nissan Rogue Sport vehicle from Nissan of Huntington at 850 E Jericho Type, Huntington Station NY 11746 on Monday, September 17,2018.

On September 22, I was driving south on Merritts Road in Farmingdale, NY. As I approached the railroad crossing that has two sets of tracks, one for eastbound trains and one for westbound trains. The gates were up, indicating it was safe to drive across the tracks. I drove over the first set of tracks (westbound) and as soon as the front of the car cleared that first set of tracks the car came to an abrupt stop. I tried to start the car, but it was locked down and would not start. While I was trying to figure out what to do next, the gates to the railroad crossing came down in front and behind me. A person in a car behind me(but not on the tracks) ran over to me in the car and screamed to me "Get out of the car because the train is coming!!".

Fortunately, I was able to get out of the car in time. However, the car was hit by the eastbound train. The damages were over $9,000. This was a traumatic incident for me and in addition, I had to pay a fine of $250 for "obstructing railroad traffic". Nissan sent a letter in response to my notification dated November 26,2018. ...It said : Thank you for allowing Nissan North America, Inc the opportunity to review the circumstances regarding the incident involving your vehicle. Please be assured that NNA has taken every step necessary to fully investigate this matter. A Nissan Specialist conducted a detailed inspection of the vehicle and found no evidence of a product problem, failure or malfunction that may have caused or contributed to the incident. Based on our inspection of the vehicle and the available information NNA finds no basis on which to offer financial assistance in this matter at this time. Please refer this matter to your insurance company...then another letter was sent states the AEB system update available if AEB Activates when not needed. In rare instance and unique roadway environments such as certain types of railroad crossings and metal overpasses, the AEB system in some vehicles may activate braking when it is not needed.....Nissan developed a special AEB system update that is available to you at your Nissan dealer at no cost for parts and labor during the duration of the Basic Coverage in your New Vehicle Limited Warranty...

When on a street in the right lane turning left (a slow left curve) going about 30 mph the automatic braking sensor (AEB) looks at objects to the right that are in front of it and slams on the brakes. It senses that something is in front of it. I thought I ran over something the first time it happened at approx 800 miles and it scared the sheeeet out of me.

I bought this car for my wife and was just glad she was not in it. About 4 days later, same thing. Now, driving it is like a terror show, with anxiety on full blast. I took it to the dealer and have a loaner right now. If it happens again I am going straight to the dealer for all my cash back and/or straight into Court. No use waiting until my wife is injured or worse until I get out of the car.

They claim they are desensitizing it right now. Funny thing is, I would drive right up behind other cars (I am obsessive about not tailgating and drive way back; am in my mid-60's with no tickets and no accidents) to see if the ABS worked and it never came on the few times I tried to force it to work. Seems like it only works whenever it feels like the driver needs to be terrorized. You can imagine driving along and all of a sudden the brakes slamming on with cars racing up behind you and you just waiting for the big BLAM!!!! They try to put too much techno on these vehicles and they go haywire .........
