After driving for 20 minutes with the cruise control previously on and set and still on but not activated, I momentarily applied the brakes at approximately 45mph then lifted my foot from the brake pedal while approaching a red light that had returned green the truck began to rapidly accelerate on its own without my assistance of applying the accelerator pedal. Quickly recognizing the unintended acceleration situation I immediately applied the brakes and was able to regain control of the truck without incident. I have taken a photo of the instrument panel within a few minutes of the unintended acceleration capturing vehicle operating conditions during the incident. Very dangerous situation that could result serious injury or death. Vehicle information should be downloaded from onboard computers right away. Please identify where the download should take place.

The contact owns a 2009 Nissan Titan. The contact stated that while attempting to accelerate from a complete stop, the service light and slip light illuminated then the vehicle stalled. The vehicle was taken to a dealer and the technician stated that the throttle actuator and ECM needed to be replaced. The vehicle was not repaired. The manufacturer was made aware of the failure. The failure and current mileage was 77,250.

2009 Nissan Titan suddenly and uncontrollably accelerated and when the brakes were depressed it did not stop the vehicle. The consumers son was driving the vehicle, when he intended to turn into a parking lot at his apartment and had come to a stop. After a car passed, he proceeded to turn into the parking lot. At that time, the vehicle suddenly and uncontrollably accelerated. He put his foot on the brake, but to no avail. The accident scene showed skid marks that he applied the brake. The vehicle proceeded and went through the wall of his living room, damaging the building and the vehicle. (lawyer wrote in on behalf client) updated 12/10/10.
