The contact owns a 2015 Ram 2500. The contact stated that while driving at 55 MPH, the brake pedal was depressed but failed to respond and the cruise control mode remained engaged. The contact stated that the vehicle accelerated and would not stop. The contact manually pressed the cruise control button to disengage it but it failed to respond and the vehicle continued to accelerate. The contact stated that as the vehicle was about to crash into another vehicle, he drove the vehicle off the road and into a ditch. The contact sustained nose hemorrhage and bruised ribs. The Contact-??s wife who was sitting in the front passenger seat sustained bruises on her face and around her eye. The contact-??s 17-month-year-old baby who was sitting in the rear passenger seat sustained a black eye and bruised chest. The contact and his family did not seek medical assistance. A police report was not filed. The contact was able to drive the vehicle to his residence without cruise control. The dealer was notified of the failure and advised the contact to take the vehicle in for diagnosis at his own expense. The dealer also advised the contact that the failure was a manufacturer defect. The manufacturer was notified of the failure and he advised the contact that they could not assist as the vehicle was out of warranty. The vehicle was not repaired. The failure mileage was approximately 140,000. Consumer added the recall from the FCA says IF! THE vehicle is having the symptoms then perform the software update. Consumer's attorney is dealing with FCA on this issue.
