Legacy Limited 2.9L

My 2006 Subaru Legacy will stall while driving at different times. You can't give it gas and the motor sounds like it has high RPM. You have to pull off road turn engine off and if you are lucky It will start back after 3 or 4 tries. If not I raise the hood and shake the battery and it will start after 3 or 4 tries. It has done this for months but until today I didn't see where anyone else had this problem also.

On my way to work at 5am, I hit the gas and it won't go ... I'm in the middle of a highway! Found a place to drift off the road. An entrance for Garbage trucks. Fortunately for me they were leaving. I had to call the police to get my car moved . I couldn't do it. So, have my car towed. I think it's fixed.

It happens two weeks later! Why, because the dealer that I took it to thought he could get away without putting in a Throttle Positioning Sensor. Thank God none of this happened when I was going really fast. It could have been worse.

Now the dealership says The part alone cost $1,000.00 from Subaru. The first time it cost me $1,400.00.

Why doesn't Subaru recall this part?

Legacy L V6

I was told 60,000 maintenance would probably clear up the problem. (code p2138 at dealer) However after doing research, I'm more worried than ever that this will happen while I'm on the highway--which I am almost 7 days/week. This seems to be a problem with Subaru for quite some time. My last Legacy lasted 13 years with no problems. This 2006 is the 4th Subaru in my family. Disappointed is an understatement.

Update from Nov 12, 2016: To update - after spending almost $1200 on maintenance, my car stalled out again within a week of the "tune-up". I contacted Subaru HQ North America because I was not going to pay for gas pedal assembly when they code clearly showed what the problem was in the beginning. A job that was around $400. They refunded me 1/2 of my money. Performed the service. No problems since. Fingers crossed. I don't plan to return to that .dealership
