The contact owns a 2005 Suzuki Verona. The contact stated that while driving 65 mph, he noticed that the speed increased to 90 mph and the rpms also increased excessively. When he depressed the brake pedal, the vehicle would not respond and the accelerator pedal was stuck to the floorboard. The contact shifted into neutral, activated the hazard lights and applied the brake pedal which eventually slowed down the vehicle. The contact called the dealer and explained the failure who stated that there was nothing they could do as since it was outside of the warranty. The vehicle was not repaired. The manufacturer was not notified. The current and failure mileages were approximately 76,000.

: the contact stated while driving 40 mph on dry roads, the vehicle accelerated without warning and without the accelerator pedal being depressed. The vehicle was taken to a service dealer 5 times where they were unable to duplicate the problem. The Suzuki company was consulted, who informed the contact that there is a diagnostic testing code that must appear while diagnosing the vehicle in order to legitimize the repair of the vehicle. However the dealer did not provide the contact with the diagnostic code.
