Camry Hybrid LA 2.4L 4 cyl.Vvti

  • Automatic transmission

I had just left a stop sign, crossing an intersection when a Ford pickup truck seemed to come barreling out of nowhere, swerved around the stopped vehicle on my left (2 lane road). We collided in the intersection, front-left-to-front right. The impact spun my car about 150 degrees with the front resting on the sidewalk to my right. The other driver's airbag did deploy, and he received a cut on his forehead (he was wearing his seat belt, as was I). Both vehicles were totaled.

I was wearing my seat belt, but my airbags did not deploy. My car had both front and side curtain airbags. I was thrown into the driver's door by the impact, breaking 4 ribs, a vertebra, my shoulder blade, and my collarbone on the left side. On the rebound from hitting the door, my right wrist and right arm just above the wrist were broken. I spent 8 days in the hospital, and 7 weeks in a convalescent/rehab facility. I am still undergoing outpatient OT for weakness and pain in my right hand and arm, and poor mobility and pain in my left shoulder. Had the side curtain airbag deployed, it would have cushioned the impact with the door, and had the steering wheel airbag deployed, it might well have thrown my right arm up out of harm's way, and I would have been saved a great deal of injury, if not all.

The airbags were Takata, but my car was not included in any of the Toyota recalls for these now-notorious devices. I would appreciate any information regarding Toyota's liability in this instance.
