Attorney writes in regards to lemon law on behalf of a client the vehicle was burning oil and it was determined it was necessary to replace the O rings. After a week at the dealership, the vehicle was returned to the consumer. The very next day, the vehicle would not start and it was towed to the dealer. The vehicle was leaking gas. It appeared the O ring was torn and all four O rings were replaced. There was a water leak inside the vehicle. The dealer ordered a special adhesive/sealant for the convertible top. The master switch that raised or lowered all of the windows did not work on a consistent basis. When the doors were opened, the front windows would go down, but they wouldn't come back up. The regulators were replaced. The left rear window would not go up at all. There was a rattle coming from the center of the dashboard at random while driving. The convertible top would not close, the luggage compartment was not properly aligned. The sunroof drains were clogged and water was backing up into the vehicle which was causing the water leak. The left front seat motor had to be replaced as the seat was not adjusting properly. The convertible top cables were fraying. The transmission was erratic and not accelerating smoothly.

The contact owns a 2007 Volkswagen Eos. The contact stated the vehicle would sporadically stall. When the failure would occur, the warning lights would intermittently illuminate on the instrument panel. The contact was able to restart the vehicle but it would not accelerate. The vehicle was towed to an authorized dealer where the contact was awaiting a diagnosis of the failure. The contact inquired with the manufacturer in regards to NHTSA campaign id number: 09V333000 (power train: Automatic transmission) but was advised by the manufacturer that his year vehicle was not included with the particular recall. The current and failure mileages were approximately 73,000.

VW Eos with 22000 miles; dsg transmission operates erratically; when accelerating from a stop car initially accelerates then slows, as if in neutral gear, then bangs into gear and accelerates. Erratic and violent downshifts have also been experienced causing occupants to be restrained excessively by the seat belts. Difficult to demonstrate this behavior consistently. Dealer initially described actions as: "normal for dsg transmission". repeated complaints to dealer led to transmission components being replaced. This resulted in some improvement but erratic shifting continues.
